    Terms & Conditions — Mindaura

    1. DEFINITIONS

    1.1 Service and Platform Terms

    • Mindaura: Operating as Mindaura (“we,” “us,” or “our”), a service of Talent Draw LLC.

    • Service: All features, functionalities, programs, and content available through Mindaura.

    • Platform: Our website, applications, and related services accessible via any device.

    • User: Any individual or entity accessing or using our services (“you” or “your”).

    1.2 Testing and Training Terms

    • IQ Score: A numerical result generated by our proprietary educational assessment algorithm.

    • Brain Training Programs: Interactive cognitive exercises and activities available on our platform.

    • Training Content: Educational materials, exercises, games, and assessments.

    1.3 Subscription Terms

    • Subscription: Recurring paid access to premium features.

    • Trial Period: Initial low-cost access period (see §6.1).

    • Standard Subscription: Recurring paid access following trial period.

    • Billing Cycle: The frequency of subscription charges (weekly, monthly, or quarterly).

    1.4 Security Terms

    • Authentication Code: Time-sensitive, single-use verification code for account access.

    • Account Security: Methods and procedures for protecting user access.

    • Access Credentials: Information used to verify user identity.

    1.5 Technical Terms

    • Force Majeure: Circumstances beyond reasonable control preventing or delaying service delivery, including: natural disasters, government actions, war/terrorism/civil unrest, cyber attacks, network/infrastructure failures, pandemics or health emergencies, ISP outages, power grid failures, or other circumstances beyond our reasonable control.


    2. WELCOME AND INTRODUCTION

    2.1 Platform Overview

    Welcome to Mindaura! We provide educational cognitive assessment and training services through our digital platform.

    2.2 Agreement to Terms

    By accessing or using Mindaura, you agree to these terms and conditions, accept our privacy policy, consent to our data practices, and acknowledge our service limitations.

    2.3 Access Methods

    These terms apply to all access methods: web browsers, mobile devices, tablets, desktop apps, third-party integrations, and any future methods.


    3. IQ TESTING AND TRAINING DISCLAIMERS

    3.1 Educational Entertainment Purpose

    Mindaura provides IQ testing and brain training services for educational entertainment only. Our services are not professional psychological tools; tests are not clinical IQ assessments; results are for personal interest and entertainment; scores should not be used for academic, professional, or medical purposes.

    3.2 Testing Limitations

    Results may not reflect actual intelligence or cognitive ability and can be influenced by environmental conditions, physical/mental state, time of day, testing environment, device/internet, stress, and familiarity.

    3.3 Training Program Disclosure

    Content is based on general cognitive exercise principles; no formal clinical studies support our specific programs; effectiveness has not been independently verified; individual results vary; game progress may not translate to real-world improvement.

    3.4 Professional Advice Notice

    We do not provide medical or psychological advice. Consult licensed professionals for clinical intelligence testing, cognitive health, educational/career guidance, or medical/psychological evaluation.

    3.5 User Responsibility

    Use is at your own risk; no guarantees of improvement are made; we are not liable for decisions based on results, academic/career choices, outcomes, emotional responses, or interpretation.


    4. ACCEPTANCE OF TERMS

    4.1 Agreement to Terms

    By using our services, you acknowledge you have read, understood, and agree to be bound by these terms. If you do not agree, do not use our services. Your continued use following any changes constitutes acceptance.

    4.2 Modifications to Terms

    We may modify these terms at any time. We will notify users of material changes via email. Changes are effective immediately for new users and 30 days after notification for existing users.


    5. ACCOUNT ELIGIBILITY AND SECURITY

    5.1 Age Requirements

    Minimum age: 18 years (or legal age in your jurisdiction). Age verification may be required.

    5.2 Account Creation

    One account per user; valid email required; accurate information must be provided and kept up to date.

    5.3 Security Requirements

    You must manage your email securely, protect access codes, report unauthorized access, and maintain information accuracy.

    5.4 Account Protection

    Passwordless authentication with single-use, time-limited codes; session security measures apply.

    5.5 Prohibited Activities

    Multiple accounts, credential sharing, false information, unauthorized access, and security bypasses.

    5.6 Organizational Usage

    Proper authority and verification required; usage restrictions apply; changes in authority must be reported.

    5.7 Data Retention Policy

    Inactive accounts (no interaction for 365 days) are permanently deleted. If you’ve had at least one conversation in the past 365 days, your data remains active until that most recent conversation exceeds 365 days.


    6. SUBSCRIPTION SERVICES

    6.1 Trial & Conversion

    • Trial: $1.95 for a 3-day trial with full access to premium features of the selected plan.

    • Conversion: After 3 days, your subscription automatically converts to the monthly rate of the plan you selected in §6.2 unless canceled before the trial ends.

    • Verification: In some regions, we may process a split or secondary micro-charge to validate recurring billing capability.

    6.2 Pricing Packages (Monthly Plans & Lifetime)

    Base pricing in USD* (regional pricing may apply — see §6.3):

    • Starter — $29/month
      Core assessments, basic personalized report & insights.

    • Advanced — $49/month
      Full analysis, improvement tips, progress tracking.

    • Pro — $99/month
      Deeper analytics, benchmarking/comparisons, priority support.

    • Expert — $109/month
      Everything in Pro plus career & personality cross-matching and advanced guidance.

    • Ultimate (Lifetime) — $900 one-time
      Non-recurring lifetime access to all current consumer features available under Expert at time of purchase, plus future consumer feature updates at our discretion. Not a subscription; no renewals.

    Plan Notes
    Feature availability may vary by region and device. We may introduce additional plans, add-ons, or promotions from time to time.

    6.3 Regional Pricing & Taxes

    • Prices may be displayed in your local currency; the exact amount shown at checkout is what you will be charged.

    • Final rates may include local sales tax/VAT, regional adjustments, currency conversion, promotions, and seasonal offers.

    • Any future changes to your subscription rate will be communicated in advance and will not retroactively affect prior charges.

    6.4 Payment and Billing

    • Security: PCI-DSS compliant processing; major cards and select local methods accepted.

    • Auto-Renewal: Monthly plans renew automatically until canceled. Lifetime plan is one-time and does not renew.

    • Failed Payments: Multiple retries over 30 days; account may be suspended after 30 days of failed payments; bank fees are your responsibility.

    6.5 Subscription Management & Cancellation

    • Cancel Anytime: You can cancel your monthly plan at any time before the next renewal to avoid further charges.

    • Effect of Cancellation: Service continues until the end of your current billing period; no partial refunds for unused time (see §7).

    • How to Cancel/Manage: Contact support@mindaura.co (include account email). We’ll confirm cancellation by email.

    • Reactivation: You may reactivate at the then-current rates.


    7. REFUND POLICY (Aligned to Packages)

    7.1 Trial Refunds ($1.95)

    Eligible for a full refund within 30 days of purchase if all apply:

    • First-time trial user;

    • No prior trial refunds on any account;

    • No terms violations;

    • Request submitted to support@mindaura.co from your account email.

    7.2 Monthly Subscription Refunds

    Monthly subscription fees are non-refundable, except in the following cases:

    • Service Unavailability: Documented downtime exceeding 24 consecutive hours, excluding scheduled maintenance and Force Majeure (§1.5).

    • Technical Issues: Verified platform bugs preventing core feature access (reported within 30 days of the charge).

    • Billing Errors: Duplicate charges, incorrect amounts, or unauthorized transactions.

    • Legal Requirements: Where applicable law mandates a refund.

    No Refunds for: partial/unused time after cancellation, plan downgrades, maintenance windows, change of mind, or failure to cancel before renewal.

    7.3 Ultimate (Lifetime) — $900 One-Time

    • Cooling-Off Window: Refundable within 14 days of purchase if there has been no material usage (e.g., no full report downloads or >2 hours of premium feature time).

    • Beyond 14 days or after material usage, the Lifetime fee is non-refundable, except for billing errors or as otherwise required by law.

    • This does not affect your statutory rights where applicable.

    7.4 Refund Process

    Email support@mindaura.co with: account email, transaction details, reason, and any supporting documentation. Standard processing target: 3 business days.

    7.5 Currencies & Conversion

    We process in USD, EUR, GBP, CAD, and AUD where available; other regions: USD. Exchange rates and any conversion fees are determined by your bank and are not refundable by Mindaura.


    8. INTELLECTUAL PROPERTY RIGHTS

    All platform content and functionality are owned by Mindaura (Talent Draw LLC) and protected by international copyright and trademark laws. We grant you a personal, non-transferable, non-exclusive license for non-commercial use. You may not reverse engineer, reproduce, remove notices, create derivatives, or redistribute content.


    9. USER CONTENT AND RIGHTS

    9.1 User Ownership

    You retain ownership of content you submit (profile info, responses, custom content); personal data remains your property per our Privacy Policy.

    9.2 License to Mindaura

    You grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable, sublicensable license to use, display, optimize, analyze, and anonymize your content for service operation, improvement, and statistics.

    9.3 Content Restrictions

    Do not submit copyrighted, malicious, harmful, inappropriate, or deceptive content.

    9.4 Quality Standards

    Content must meet technical requirements, formats, quality guidelines, and safety standards.


    10. SERVICE LEVEL AGREEMENT (SLA)

    • Availability: 97% annual uptime target; maintenance and Force Majeure excluded.

    • Changes: Standard (15-day notice) vs. emergency (immediate).

    • Maintenance Windows: 24-hour notice when scheduled, up to 4 hours during low-usage periods.

    • Credits: 95–97% uptime → 3-day credit; 90–95% → 7-day credit; <90% → 14-day credit.


    11. TECHNICAL REQUIREMENTS

    Supported browsers (Chrome ≥90, Firefox ≥88, Safari ≥14, Edge ≥90); responsive design; minimum 320×480; recommended 768×1024. iOS ≥13 (recent devices listed), Android ≥8.0 with security patches. Stable internet (min 1 Mbps; 5 Mbps recommended; ≤300ms latency). RAM 4GB (8GB recommended), 1GB storage, multi-core 2GHz CPU. JavaScript, cookies, HTTPS, and local storage required.


    12. CUSTOMER SUPPORT AND COMPLAINTS

    Support available 24/7/365 via Help Center and support@mindaura.co. Average response ~6 hours; initial response within 24 hours; resolution target 3–5 business days. Complaints require full name, account email, issue details, documentation, timeline, and prior communications. Escalation paths and QA reviews apply.


    13. LIMITATION OF LIABILITY

    Our maximum aggregate liability will not exceed the amount you paid in the 12 months preceding the claim. We are not liable for lost profits, business interruption, opportunity loss, data loss, substitute services, consequential/incidental/punitive/special damages, emotional distress, reputational damage, device/internet issues, or outcomes based on assessments. No liability for accuracy of IQ results, program effectiveness, or specific improvements. Force Majeure applies. You agree to indemnify and hold us harmless for violations, misuse, content submitted, legal non-compliance, and third-party claims.


    14. DISPUTE RESOLUTION

    14.1 Governing Law and Jurisdiction

    These terms are governed by the laws of the State of Nevada, USA. Exclusive venue and jurisdiction lie in the state or federal courts located in Clark County, Nevada. You consent to personal jurisdiction there.

    14.2 Mandatory Arbitration (Except as provided in §14.5)

    • Administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in English, with a single arbitrator.

    • Written notice, claim description, documentation, and proposed resolution required; 60-day resolution window.

    • Proceedings may include virtual hearings, document exchange, witnesses, expert evidence; a reasoned written decision will be issued.

    • Costs: Filing fees and arbitrator fees shared unless otherwise awarded; each party bears its own legal fees.

    14.3 Class Action Waiver

    You waive rights to class actions, class-wide arbitration, consolidated or representative claims; disputes must be resolved individually.

    14.5 Exceptions

    IP disputes, small-claims actions, emergency equitable relief, and claims within statutory time limits may proceed outside arbitration.


    15. SERVICE MODIFICATIONS

    We may modify, suspend, or discontinue features, content, or infrastructure. Material changes: 15-day notice with documentation and transition guidance. Emergency changes: immediate for security, compliance, stability, or Force Majeure. Non-material updates (bug fixes, performance, UI, docs) may occur without notice.


    16. ACCOUNT TERMINATION

    16.1 User-Initiated

    You may terminate your account at any time by contacting support@mindaura.co. Termination is effective immediately; no fees; subscription access continues until the end of the current billing period; no refunds for unused time (see §7).

    16.2 Mindaura-Initiated

    We may terminate for terms violations, fraud, abuse, security issues, payment defaults, account sharing, false information; or for legal/regulatory reasons.

    16.3 Post-Termination

    Immediate discontinuation of service, code deactivation, API and integration closure, and account deactivation. Data handled per legal requirements; user content archived for 30 days. Subscriptions are canceled; any credit balance may be refunded if applicable.

    16.4 Reactivation

    Available within 30 days at current terms/pricing; previous usernames may be unavailable; subject to approval.
